Terms and Conditions

1. Purpose

These Terms and Conditions (hereinafter "Terms") govern the use of the OpenChantier platform (hereinafter "the Service").

The Service is a web-based project management application designed for tradespeople and small construction businesses.

2. Acceptance of Terms

Use of the Service constitutes full acceptance of these Terms. By creating an account, the User acknowledges having read and accepted these Terms without reservation.

3. Registration and account

Access to the Service requires creating an account. The User agrees to provide accurate and up-to-date information.

The User is responsible for keeping their login credentials confidential. Any activity carried out from their account is deemed to have been performed by them.

4. Description of the Service

OpenChantier provides the following features:

  • Project management (creation, tracking, archiving)
  • Taking and storing site photos
  • Time tracking per project
  • Quote and invoice generation; PDF export and sending to the client (paid plans)
  • Progress sharing with clients via secure link
  • Team management and collaboration

Available features depend on the subscribed plan (Free, Pro or Pro Team).

5. Plans and pricing

The Service is offered in three plans, whose features and limits are as follows:

  • Free plan: a single user, up to 3 active or paused projects and 2 GB of storage. Quotes and invoices may be prepared within the application, but exporting them as PDF and sending them to the client are reserved for the paid plans; no collaborator or subcontractor may be invited. Sharing a project's progress with the client, including message exchanges and the client's confirmation of snagging items, is included at no extra cost.
  • Pro plan (€15/month): a single user, unlimited projects, 50 GB of storage, PDF export and sending of quotes and invoices, electronic invoicing, online quote signature, automatic reminders, planning, snagging lists, project templates, visit reports and profitability analytics. Up to 10 subcontractors may hold access at the same time, free of charge, for an access period of 1 to 90 days chosen when the invitation is sent.
  • Pro Team plan (€29/month): all the features of the Pro plan, 5 seats included (the account holder and 4 collaborators), 200 GB of storage, role management and per-collaborator profitability tracking.

Beyond the 5 seats included in the Pro Team plan, each additional collaborator is charged €9 per month. The seat is added to the subscription only after the account holder has expressly confirmed the amount, and is billed only from the moment the invitation is accepted. The total number of collaborators attached to a single company is capped at 50, across all plans.

Each plan includes a storage allowance for photos and documents, measured per company rather than per user: 2 GB on the Free plan, 50 GB on the Pro plan and 200 GB on the Pro Team plan. Once that limit is reached, uploading further files may be suspended until space is freed or the plan is upgraded; no file already uploaded is deleted as a result.

The Service includes no free trial period. The Free plan is available without time limit and without a payment card; any paid subscription is charged as soon as it is taken out and renews automatically each month until it is cancelled under the conditions set out in article 9.

Prices are stated in euros, inclusive of applicable taxes. The Publisher reserves the right to change prices with 30 days' notice to Users.

6. Personal data

The processing of personal data is detailed in our Privacy Policy. The User consents to the processing of their data in accordance with the GDPR and the French Data Protection Act.

7. Intellectual property

All elements comprising the Service (text, graphics, software, trademarks, etc.) are the exclusive property of the Publisher or its partners.

The User retains full ownership of content they publish via the Service (photos, documents, project data).

8. Liability

The Publisher undertakes to use all reasonable means to ensure the availability and security of the Service.

The Publisher shall not be liable for indirect damages resulting from the use or inability to use the Service.

The User is solely responsible for their use of the Service and the data they enter.

9. Termination

The User may cancel their account at any time from their account settings. Cancellation of the Pro plan takes effect at the end of the current billing period.

The Publisher reserves the right to suspend or delete an account in case of breach of these Terms.

10. Reversibility and return of data

The User may at any time, from Settings and then the Account section, export their data as a usable JSON file. That export contains their profile, their company details, their projects together with the materials, logged hours, expenses and notes attached to them, their quotes and invoices, and their client records. It is free, unlimited, and requires no prior request to the Publisher.

Files uploaded by the User — site photos and documents — are not included in that export. They remain viewable and downloadable from the Service for as long as the account is active; it is the User's responsibility to retrieve them before deleting the account.

Cancelling a paid subscription deletes no data: the account reverts to the Free plan, whose limits then apply to anything created thereafter. If the User owns a company that still has members, they must first transfer ownership to a colleague or remove those members: deletion is refused until then, so that no company is left without an owner. Once that condition is met, deleting the account is immediate and irreversible; Users are advised to run their export before requesting it. Issued invoices and quotes are retained for 10 years under accounting obligations, on the terms described in the Privacy Policy.

11. Applicable law

These Terms are governed by French law. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the French courts.
